Orlando Time Sharing Attorney Explains Florida Child Support Calculations

Back To Divorce and Family Law Videos

I mention in this video that the number of overnights plays a major role in how child support calculations are made but, as an Orlando time sharing attorney, I feel like it’s important that I delve into that subject a bit more deeply.

The laws in Florida are clear and precise on how time sharing affects the cost of child support—or at least when time-sharing actually starts to count. This is vital for people to know because they might be thinking, “Hey, I see my kid once a month. I shouldn’t have to pay as much in child support because of that.” But under Florida law, that’s just not the case.

Orlando Time Sharing Attorney: When Time-Sharing Affects Child Support

In order for the parent who has less time with their child to have that time offset some of their child support payments, they need to have a minimum of 73 overnights a year. That means having your kids stay with you for almost three months straight, for more than one night every weekend, or something in-between those two extremes.

If you are not able to spend that much time with your kids, it’s not going to help you reduce your child support obligations. Luckily, most divorced parents strive to spend as much time as they can with their children, so this is just one more reason to push for additional time.

Florida Time Sharing Attorney: Child Support Related to Time-Sharing Isn’t Written in Stone

Also important to know is that calculations based on time-sharing can be changed over time if one parent stops taking care of the child or children. If you’re the one bearing the brunt of the care, this is a good thing. Not only will you get more child support, it will be retroactive to the date that your ex-spouse first stopped following the court-ordered or agreed time-sharing schedule. And for those who struggle with having enough time to devote to parenting, it’s worth remembering this as encouragement to make your children a priority to the extent that you are able. If you’re not sure how a specific change might affect your child support and you want an expert opinion, call an Orlando time sharing attorney today.
