As a personal bankruptcy attorney who handles a lot of Orlando foreclosure cases, I know that there’s more to being a lawyer than the honesty and integrity that I mentioned above. Those are qualities that you look for once you believe that you’ve found someone who seems to be respected and knows what they’re doing.

But how do you know if they know what they’re doing? After all, you probably wouldn’t be coming to a lawyer if you knew how to handle your own case. If you’re considering bankruptcy and looking for a lawyer, here are several questions to ask to see if they’re both knowledgeable and trustworthy – find that and you’ve probably found someone for the long haul.

Questions for a Personal Bankruptcy Attorney

Not everyone is going to have the same answers to these questions, and that’s okay. The goal is simply to get a sense of the breadth and depth of their knowledge, while trying to determine their values and integrity.

What do you need to know to start my case? If they shrug when you ask this and say they can figure it out, you might want to run the other way. Bankruptcy cases require detailed financial records, and you’re going to be the one providing them. Someone who says they don’t need anything either doesn’t know what they’re doing or is trying to milk you.

Is your fee agreement written? A good personal bankruptcy attorney won’t agree to do anything verbally, and neither should you. Make sure you see a formal, written agreement drawn up that not only lists fees, but explains in clear detail what those fees include.

Should I declare bankruptcy? Talk about a loaded question, but it’s a good one if you want to gauge where an attorney stands. A pat answer here just doesn’t suffice, because every situation is different. You want someone who provides a broad overview of your options – and what will likely happen in each case – before asking you to make a decision.

There are lots of people facing Orlando foreclosure these days because of the economy and the down housing market, but that doesn’t mean that bankruptcy is necessarily the only option out there for you.
