Liability and Causation in a Florida Car Accident

Proving liability involves an attorney finding concrete evidence that someone else is at fault for the client’s accident or injury. Police reports, witness statements and a vehicle’s black box recorder can help show liability. Witness statements and other data also help point to who is responsible in a personal injury case.

Damages in a Personal Injury Case

In Florida, there are two types of financial awards an injured client can recover: compensatory and punitive damages.

Compensatory damages are “actual” costs the client incurs because of his or her injury. For example, if you are unable to work or have to replace a vehicle or pay current (and future) medical bills, you are paid (compensated) for these expenses in a judgment for compensatory damages. You may have also heard of an award for “pain and suffering” in a case. Your pain and suffering because of someone else’s negligence can be awarded in compensatory damages.

Consider punitive damages as a punishment to the liable party when it appears the party intentionally, willfully, maliciously, or criminally caused the accident or injury. In order to obtain punitive damages for a client, an attorney must prove that whoever is responsible in a car accident or personal injury case was aware that his or her actions leading up to the accident could cause an injury.

If punitive damages are awarded, they are generally based on either three times – or up to $500,000 – of the compensatory damage ordered, or four times – or up to $2 million – if the injury is caused for financial gain or specific intent to harm.
