  • Negotiating a new payment plan with your lender. A loan workout may involve lower payments or rates, and may bring your payments current if you are behind.
  • Arrange a consent judgment or short sale which will allow the bank to foreclose, but waives the debt deficiency. For instance, with a consent judgment, if you owe $200,000 on your home and it sells for $100,000, you will owe nothing.
  • Renegotiate your second mortgage. Since the holder of your primary mortgage has first claim on the value of your home, the holder of your second mortgage has little recourse for payment if your home’s value has declined significantly. We have negotiated the payoff of second mortgages for 10 and 20 cents on the dollar or less.
  • Examining the terms of your loan for Truth in Lending violations. Federal law is unforgiving regarding violations. If your lender committed even a minor infraction, your whole mortgage may be rescindable or void.
