Constructive Possession and the Burden of Proof

In this kind of case, Florida criminal law says that the burden of proof is on the government. That means that it is up to the court to prove the following three things:

  1. The drugs were within the defendant’s control
  2. The defendant knew that the drugs were in that location
  3. The defendant knew that the drugs or contraband were illegal

The court must prove these three things beyond a reasonable doubt, meaning that they must have concrete evidence on all three points. For example, the arresting officer cannot just say that the driver of a car with three passengers was in possession of drugs found in that car because that fact alone does not prove the driver’s guilt beyond a reasonable doubt.
