Florida lawsuits are usually brought on behalf of the deceased by the surviving spouse, child, or parent. Florida Statute 768.16-768.26 is known as the Florida Wrongful Death Act.

The Act establishes the public policy of the state to shift the resulting losses from the survivors of the decedent to the wrongdoer. There are numerous wrongful death situations, which include, but are not limited to:

  • airplane accidents, motorcycle accidents, or automobile accidents
  • criminal attacks
  • medical mistakes or medical malpractice
  • supervised activity, i.e., work or school scenarios
  • defective products or products liability
