Defending a DUI in Florida can involve receiving a request for admissions from the opposing counsel. If you watched the above video, you know that you have to answer the request or you risk forfeiting the case and admitting guilt. How exactly do you answer the questions? After all, this is one of those situations where anything you say can be used against you.

An Overview to Answering Request for Admissions Questions

Responses in a Request for Admissions must be worded effectively, and you have an obligation to respond in good faith. An Orlando criminal defense attorney who handles DUI cases will ensure that the language you use does not leave you open to further questions in any surprising ways.

There are four basic ways to answer request for admission questions: admit, deny, partially admit or deny, and unknown or unsure.

If you agree with the statement, all you have to do is write the word “admit” underneath it. This is common for admissions statements concerning things like your name, place of business, and so on. Simply write that one word and you are done – just be careful that you are not admitting to anything that you later want to contest.

For everything else, you are required to explain your answer, and that is where answers to admissions questions become more involved. You have to know precisely what language to use when explaining your answers or you risk potentially harming your case in some way. You want to provide enough information so that you are obeying the law without giving your opposition anything that they can use. You may also file an objection in response to any questions that are unclear, compound, or unreasonable.

Keep in mind that this discussion is a generic explanation to what will be very specific questions on the Request for Admissions.

If you are on the receiving end of request for admissions, the best way to respond is to work with a knowledgeable DUI defense lawyer. That way, you know that your Florida DUI will be handled by someone who knows the rules, the courts, and the procedures inside and out.
