“The CSI Effect”

“The CSI Effect” refers to the way that shows like CSI have shaped the way our culture views criminal trials. CSI places a lot of emphasis on forensic evidence and exaggerates the extent to which certain types of technology are available. This makes some people believe that all it takes is for their Florida defense attorney to find a key piece of forensic evidence for charges to be dropped. Unfortunately, this generally is not the case. Sometimes the technology just is not available, and in some cases forensic evidence alone is not enough.

Expecting Your Criminal Defense Attorney to Withhold Evidence

As a defendant, you have a legal right to access many types of evidence that may be used against you during your trial, such as tape-recorded statements you made to the police or summaries of statements made by experts. Being able to access these types of evidence is part of a fair trial and is meant to minimize surprises in the courtroom. But you cannot have your lawyer suppress any of this evidence during the trial.

Any evidence related to your case that the government has will be used by the prosecution; it would be illegal for your criminal defense attorney to try to pressure the prosecution into withholding the evidence.
