  • For any morphine, opium, oxycodone, hydrocodone, or hydromorphone: You possess 4 or more grams
  • For amphetamine or methamphetamine: You possess 14 or more grams

When Might a Prison Sentence Be Waived for Trafficking Charges in Florida?

Under Florida criminal law, drug trafficking is a first-degree felony. If you are charged with trafficking, there will be a mandatory prison sentence unless the Office of the State Attorney waives it in favor of another legal sentence. Here are just a few reasons why you might be able to get your prison sentence waived:

  • The facts of the case against you are weak;
  • Your Florida criminal defense attorney successfully makes a motion to suppress based on a legal issue in the case—for example, maybe the search and seizure that led to your arrest was unconstitutional;
  • If you struggle with a drug addiction and were not planning to sell the drugs, your lawyer may be able to work out a drug treatment rehabilitation program instead of a prison sentence.
