Florida Criminal Defense Attorney Talks Trafficking Charges

The above video focuses on trafficking charges and why it is important to work with a Florida criminal defense attorney if you have been caught in possession of drugs—even if you have not sold any drugs. I would like to go into a little more detail about what exactly constitutes drug trafficking under Florida criminal law and cases in which you may be able to avoid serving prison time.

What Constitutes Trafficking?

As explained in the video, you can be charged with trafficking even if you were not planning on selling the drugs in your possession. A trafficking charge in this case is based on the amount of drugs in your possession. Here is a look at some of the specific amounts of illegal substances that would result in a trafficking charge in a Florida court of criminal law, if these amounts were found in your possession:

  • For marijuana: You possess 25 or more pounds of cannabis, or you have 300 or more cannabis plants
  • For cocaine: You possess 28 or more grams
  • For any morphine, opium, oxycodone, hydrocodone, or hydromorphone: You possess 4 or more grams
  • For amphetamine or methamphetamine: You possess 14 or more grams

When Might a Prison Sentence Be Waived for Trafficking Charges in Florida?

Under Florida criminal law, drug trafficking is a first-degree felony. If you are charged with trafficking, there will be a mandatory prison sentence unless the Office of the State Attorney waives it in favor of another legal sentence. Here are just a few reasons why you might be able to get your prison sentence waived:

  • The facts of the case against you are weak;
  • Your Florida criminal defense attorney successfully makes a motion to suppress based on a legal issue in the case—for example, maybe the search and seizure that led to your arrest was unconstitutional;
  • If you struggle with a drug addiction and were not planning to sell the drugs, your lawyer may be able to work out a drug treatment rehabilitation program instead of a prison sentence.

It is important to work with an experienced criminal lawyer if you are facing trafficking charges. A seasoned defense attorney at TK Law will have a good line of communication to the state attorney. We have a strong understanding of Florida criminal defense law, and will work to help you avoid serving time in prison whenever possible. Contact us for prompt, dedicated assistance.
